Finsweet Legal Agreements and Policies for Products and Services
1. Welcome

We're thrilled to have you use Finsweet's Products and Services. This document outlines the EU & Swiss Privacy Policy ("Policy") for individuals in the United Kingdom (UK), European Union (EU), European Economic Area (EEA), and Switzerland when you use our Services.

Finsweet Inc. is the company behind all the awesome Products and Services you're using. When we say "Finsweet," "we," "us," or "our" in this Policy, we’re talking about Finsweet Inc. When we say "you" or "Customer," we mean you - the individual or company using our Products and Services.
By using Finsweet's Products and Services, or accessing our content on any platform, you're agreeing to this Policy, so give them a thorough read. If you're accepting for a company or other legal entity, you're confirming you've got the authority to do so. In that case, "you" means that entity. By accepting this Policy, you're confirming that you have the right to enter into this agreement, either for yourself or on behalf of your company. If you're acting on behalf of a company, you're promising us that you have the authority to bind that company to this Policy.
Capitalized terms not defined in this Policy have the meaning given to them in our other applicable agreements referenced herein.

Finsweet’s “Products and Services” include:
- Products, like Wized, Attributes, Client-First, Components, and CMS Bridge
- Content, like SEO Guide, tutorials, documentation, educational resources, affiliate links, this website (Finsweet.com and any subdomain of Finsweet.com), and YouTube content.
- Tools, like Finsweet Extension, Support Forum, Open Source initiatives, code snippets, and repos
In our Agreement, we may say “Products” or “Services” to represent Products and Services. We’re always innovating at Finsweet, so this list of Products and Services may change. Any future Products that we create at Finsweet will also be covered under this Policy and the Agreement.
1.3 Applicable terms
When you use Finsweet's Products and Services, you're agreeing to this Policy, as well as our Acceptable Use Policy, Intellectual Property Policy, Cookie Policy, and any other applicable agreements or policies referenced on website’s legal pages (collectively, the "Agreement"). You can find these applicable agreements and policies at Finsweet.com/legal/home. If you're using specific Finsweet Products or Services, additional terms may apply—we'll make sure to let you know about those.
Remember, this Policy apply from the moment you start using our Products and Services until you decide to stop using them or your subscription ends.
Please take the time to read through this Agreement carefully. By using Finsweet's Products and Services, you're indicating that you understand and accept this Policy. If something doesn't make sense or you don't agree with part of it, please don't use our Products and Services until we've had a chance to clarify things for you.
We know that was a lot of legal language, but it's important stuff. Here's what it means in simpler terms:

- Finsweet: Depending on how you're interacting with us, we may be a "data controller" or a "data processor":some text
- We're a "data controller" when you provide information directly to us, like when you sign up for our newsletter or create a Finsweet account.
- We're a "data processor" when you use our Services or Products to handle your own data, like when you're using Wized to build a web application.
- Your website's visitors: Remember that you're responsible for the privacy of your site's visitors. Make sure you have your own privacy policy in place to cover how you handle their data.
3. What we're collecting
We gather various types of personal information when you use our Services. Here's a breakdown:
- Registration data: Your name, email, maybe your social media info if you use it to log in.
- Profile data: Your bio, avatar, work portfolio, skills, freelance availability.
- Financial data: Bank details, payment info, transaction history, company billing info.
- Transaction data: Info about your Finsweet-related transactions, like client names, completed projects, publish dates.

- We need your data to deliver our web development magic. For instance, when you're using Wized to build a web app, we need certain info to make that happen. No data, no Service - it's that simple.

- We use your data to send you important updates about your account, security issues, or other need-to-know info. Without this, you might miss crucial updates that affect how you use our Services.

- We process your data for quality control and staff training. This helps us keep our Services running smoothly and accurately.

- Product usage data: We hang onto this for up to 5 years, but we delete it automatically on an ongoing basis.

We use approved methods to transfer your personal information in and out of the United States and other countries. For transfers to the U.S., we follow the EU-U.S. and Swiss-U.S. Data Privacy Framework, as well as the UK Extension to the EU-U.S. Data Privacy Framework.
If you want to dispute something under the Data Privacy Framework, we've got instructions for that. And if the Framework ever becomes invalid, we've got backup plans using Standard Contractual Clauses or other valid transfer methods.
9. Keeping your data safe as it travels
We're serious about protecting your data, even when we have to share it with third parties. We make sure that anyone we work with provides the same level of protection required by the Data Privacy Framework and data protection laws.
We're also clear about why we're processing your data and we stick to what we've told you we'll do with it.
If the U.S. government asks, we'll show them our privacy agreements with Service providers and third parties. And if we're ever required by law to disclose your information to public authorities, we'll let you know unless we're legally prohibited from doing so.
10. Keeping your data secure
We use top-notch physical, electronic, and administrative safeguards to protect your personal information. For the nitty-gritty details, check out Section 6 of our Global Privacy Policy.
11. Direct marketing
When we say "direct marketing," we mean communications that are all about advertising or promoting our Products and Services. This doesn't include transactional emails about your account or our Services.
For our customers, we'll only send marketing emails based on our legitimate interests or with your consent. When we're relying on legitimate interest, we'll only send you info about Services similar to what you've bought or considered before.
Not interested? No problem. You can opt out of marketing emails in your account settings, by clicking the unsubscribe link in our emails, or by dropping us a line at [email protected]. You can say no to direct marketing anytime, and it won't cost you a penny.

- Binding arbitration: In some cases, you might be able to request binding arbitration before a Data Privacy Framework Panel.
- Supervisory authority: You always have the right to file a complaint with a competent supervisory authority.

15. Protecting young users
We take the protection of young users seriously. We don't knowingly collect personal information from anyone under the age of consent in their jurisdiction (which can be between 13 and 16 years old, depending on where you live).
If we find out we've accidentally collected data from someone underage, we'll delete it ASAP. If you know of anyone under the age of consent using our Services, please let us know and we'll take care of it.
16. If you don’t agree, stop using our services
Make sure sure you agree to this Policy and every policy that’s part of the Agreement. If you don’t, you should discontinue use of Finsweet’s Products and Services immediately.
17. Changes to this Policy
We may update this Policy from time to time to reflect changes in our Services, legal requirements, or business practices. If we make any significant changes, we'll notify you by email or by posting a prominent notice on our website before the changes become effective. We encourage you to review this Policy periodically for the latest information on our service policies. Your continued use of Finsweet's Services after any changes constitutes acceptance of the updated Policy. If you don't agree with the revised Policy, you should discontinue use of our Services.
